Attorneys fees are regulated by State law and by the Division of Workers' Compensation. The law allows attorneys to charge up to 25% of all monetary compensation that is not paid voluntarily by the employer or their insurance company. Different rules apply when the employer made a written offer of settlement before the attorney is hired. In that case, the attorney can charge up to 50% of the increase obtained, not to exceed 25% of the entire settlement. All attorney fees must be approved by the Administrative Law Judge assigned to the case.
